3. Puropose and scope of the application

3.1 These are the general conditions (hereinafter "General Conditions") that govern the access, navigation and use of websites under the domain "meteoflight.com" (hereinafter meteoflight.com or Website) and responsibilities arising from the use of its contents (hereinafter "contents" referring to the texts, graphics, drawings, designs, codes, software, photos, music, videos, sounds, databases, images, expressions and information).

3.2 It is understood that access or mere use of meteoflight.com by the User implies acceptance of the general conditions that MeteoFlight has published at any time in accessing meteoflight.com. Consequently, the User must carefully read these terms.

3.4 Before using and/or contracting these specific services provided by MeteoFlight, the User must carefully read the corresponding particular conditions created for this purpose by MeteoFlight. The use and/or contracting or these specific services implies the acceptance of the particular conditions that regulate them in the version published by MeteoFlight when such use and/or contracting occurs.

4. Access

4.1 Access to meteoflight.com by Users is free and gratuitous; however, some of the services and content offered by MeteoFlight or third parties through the meteoflight.com may be subject to the prior hiring of the service or product and to pay a sum of money in the manner set forth in the relevant Particular Conditions, in which case it shall be made clearly available.

4.2 When necessary for the User to register or provide personal information to access any of the specific services, collection, treatment, and where appropriate, the transfer or disclosure of personal data of Users, have to follow the Privacy Policy from the meteoflight.com.

4.3 Purchasing products and services is prohibited through meteoflight.com by minors, whereby they must have duly obtained the consent of their parents, guardians or legal representatives, who will be held responsible for the acts carried out by the children in their care, according to the regulations.

5. Use of the page

5.1 For the use and/or hire of a service from the meteoflight.com, the User must register; they will be responsible for providing true and lawful information. If as a result of registration, the User is given a password, they undertake to diligently keep the password secret to access these services. Consequently, Users are responsible for the custody and confidentiality of any user names and/or passwords that are supplied by MeteoFlight, and agree not to transfer them to third parties, either temporarily or permanently, or to allow access to outsiders. Users shall be responsible for misuse of the services by any illegitimate third party using a password for this purpose because of carelessness or its loss thereof by the User.

5.2 In light of the foregoing, the User is obliged to immediately notify the managers of meteoflight.com about any act that allows the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access, in order to proceed to immediate cancellation. While such acts are not disclosed, MeteoFlight will be exempt from any liability that may arise from misuse of identifiers or passwords by unauthorized third parties.

5.3 The access, navigation and use of meteoflight.com is the responsibility of the User, so the User agrees to diligently and faithfully monitor any additional instructions provided by MeteoFlight or authorized personnel from MeteoFlight on the use of meteoflight.com and their content.

6. License on communications

6.1 In the event that the User sends information of any kind to meteoflight.com, they represent, warrant and agree that they are entitled to do so freely, that such information does not infringe any copyright, trademark, patent, commercial trade secret, or any other third party right, that such information is not confidential and that such information is not harmful to others.

6.2 The User accepts responsibility and leaves MeteoFlight unmarred for any communication made personally or in their name, reaching said liability without restriction to the accuracy, legality, originality and ownership of it.

7. Responsibilities and guarantees

7.1 MeteoFlight does not guarantee the legality, reliability, usability, or accuracy of the services or information provided by meteoflight.com.

7.2 Accordingly, MeteoFlight does not guarantee or accept the responsibility for: (i) the continuity of the contents of meteoflight.com; (ii) the absence of errors in these contents or the correction of any defects that may occur; (Iii) the absence of viruses and/or other harmful components in meteoflight.com or the server that supplies; (Iv) the invulnerability of meteoflight.com and/or the protection of the security measures adopted therein; (V) the lack of utility or performance of the contents of meteoflight.com; any damages caused to it or a third party, anyone who breaches the conditions, rules and instructions set forth by MeteoFlight for meteoflight.com or through breach of the meteoflight.com security systems.

However, MeteoFlightdeclares that it has taken all necessary measures, within its capabilities and state of technology, to ensure the functioning of meteoflight.comand avoid the existence and transmission of viruses and other harmful components to Users.

8.5 MeteoFlight is not be liable for any damages of any kind caused by the services provided by third parties through this website, and in particular, without limitation, those caused by:

• The incorporation of viruses or any other computer code, files or programs that may damage, interrupt or impede the normal functioning of any software, hardware or telecommunications equipment.

9.3 In case of redistribution in televised media or print media, the citation of meteoflight.com as the author of the product must be legible under normal conditions by the viewer or reader.

9.4 In the event that redistributed products contain an integrated logo of meteoflight.com, this must remain unchanged and visible at all times.

9.5 In the case of graphic products based on ECMWF: MeteoFlight has license to publish graphic products based on ECMWF. However, these graphic products cannot be used, under any circumstances, by an end user for the development of Added Value Services. 10. Duration and modification

10.1 MeteoFlight may modify the terms and conditions herein, in whole or in part, publishing any change in the same way these general conditions appear or through any type of communication directed to Users.

10.2 The validity of these general conditions coincides therefore with the time of their exposure until they are modified in whole or in part, at which point the modified conditions will come into effect.

10.3 Notwithstanding the provisions of special conditions, MeteoFlight may terminate, suspend or discontinue at any time without prior notice, access to the page content, without possibility for the User to demand compensation. Following such termination, the prohibitions of use of the contents set out above in these terms will continue to be valid.

11. Overview

11.1 The headings of the various clauses are for information only and do not affect, qualify or extend the interpretation of the general conditions.

11.2 In the event of any conflict between the provisions of these terms and conditions of each specific service, the latter shall prevail.

11.3 In the event that any provision or provisions of these conditions shall be considered null or irrelevant, in whole or in part by any court, tribunal or administrative body, such ruling would not affect the other provisions of the general conditions or the specific conditions of different services from MeteoFlight.

11.4 The failure of MeteoFlight to exercise or enforce any right contained in these terms shall not constitute a waiver thereof, unless expressly stated in writing.

12. Jurisdiction

12.1 The relationships established between MeteoFlight and the User shall be governed by the provisions of existing rules concerning applicable law and jurisdiction. However, for cases in which the regulations foresee the possibility of the parties to submit to jurisdiction, MeteoFlight and the User, expressly waiving any other jurisdiction that could correspond, they will be subjected to the Courts and Tribunals of the city of Lorca.
